.com is managed by Verisign an company from US. Your domain can be seized easily, since it is under US Control.

.to is not secured anymore, still be fine to slowly the process, but now they have subpoena to know the owner behind .to.

Domains that are still good are: .ru , .su, .cr , .is, .sc, .ch, .se

If you want something like .com, is best you use .org and use EasyDNS (look at piratebay.org registar is EasyDNS and requires court order from Canada to takedown) is for that reason why TPB (ThePirateBay) still with .org domain.

But the registar can agree and seize the .org, it depend of registar.
